How does a trademark watch work?

Trademark watch consists of automatic monitoring, carried out by our software, of the trademark registration databases for UK and European trademarks, as well as international trademarks designating the UK territory.

Each month, you receive a watch report listing similar or identical trademarks that have been filed in the UK. It also includes the relevant product and service classes, the name of the applicant, and an indication of the level of risk associated with the filing.

A trademark appears similar or identical: how can I protect my trademark?

You must first ensure that you have the right to take action to defend your trademark. This means checking the similarity of the goods and services with those of the infringing trademark, as well as the degree of alphabetical and phonetic resemblance between the two marks.

In the event of a potential conflict, you have several courses of action: an amicable action (sending a cease-and-desist letter) or an administrative action (filing an opposition).

You can therefore oppose the registration of the new trademark. If it is a UK trademark, you have two months from the filing date published in the UK IPO’s online Trade Marks Journal. For international registrations designating the UK, you have two months from the publication in the Word Intellectual Property Office (‟WIPO”) Gazette of International Marks.

Finally, if the deadline has passed, it is still possible to bring a trademark infringement action against the use of your trademark. From the moment you became aware of the infringing acts, you have five years to take action before the competent judicial court.
